SUPREME COURT AFFIRMS SENATORS' POSITION IN EMPLOYEE FURLOUGH CASE
(HARRISBURG) -- State Senators John R. Gordner (R-27), Jeffrey E. Piccola (R-15), and Jane Earll (R-49) welcomed the Pennsylvania Supreme Court opinion yesterday which concluded that Governor Ed Rendell is not required by law to institute furloughs or “payless paydays” in the event of a budget impasse. Chief Justice Ronald Castille, writing for the 6-1 majority, concluded “that (Article III) Section 24 (of the Pennsylvania Constitution) did not prohibit the Commonwealth from continuing to employ and pay all FLSA (Fair Labor Standards Act) nonexempt Commonwealth employees in the event that the Pennsylvania General Assembly failed to pass a budget by July 1.”

Weekly Column: More Accountability, Oversight & Opportunities Needed for State's Charters
Since the passage of the Charter School Law in 1997, students across the Commonwealth have been given the opportunity to choose an alternative to traditional public education. For the past 12 years, students have been utilizing publicly funded charter schools, which do not have many of the restrictions that traditional public schools have. According to the Pennsylvania Department of Education, about 67,000 students currently attend charter schools, which are overseen by independent boards.

Today’s 529 college savings plans are important investments for many families looking for a strategy that will reward their children in future years. Pennsylvania’s Guaranteed Savings Plan provides the advantages of 529 plans and is promised to “guarantee” that a family’s savings will keep up with the rising cost of college tuition. This program was created with the intention of allowing individuals to save for tomorrow’s college expenses at today’s lower rates. However, thousands of investors saving for college in the Commonwealth’s Guaranteed Savings Plan will soon be forced to pay more in order to lock in future tuition expenses at today's prices.

In recent days, the Governor once again began touting the amount of new revenue available from the Commonwealth’s slot machines. He lauded the amount – $770 million – as a major achievement and sign of the state’s commitment to property tax “relief” for families, particularly during these difficult economic times. He also pledged to all Pennsylvanians that the state will continue to collect $1 billion a year from casinos. However, this is all under false pretenses and where the promises end.

Weekly Column: Budget Proposal Will Require Close Scrutiny of Governor's Spending
Before a joint session of the General Assembly, Governor Rendell delivered his annual state budget address last week. He proposed a spending plan that contains no broad-based state tax increases, but slashes numerous programs that have survived previous cost-cutting efforts. There are a number of spending components to his proposal that will require close study and further discussions in the coming weeks and months, particularly as they relate to education. This certainly is not the year to fund new programs or new spending initiatives.

Weekly Column: Piccola's Goals as the New Chair of the Education Committee
Since our founding, the Constitution of Pennsylvania has provided for the education of the citizens of this Commonwealth. In colonial days, both the Governor and the ‘Provincial Council’ were tasked to ‘erect and order all publick schools and incourage and reward the authors of usefull sciences and laudable inventions in the said province.’ In 1776, the Constitution held that “a school or schools shall be established each county by the Legislature, for the convenient instruction of youth…,” and in 1790, “the Legislature shall, as soon as conveniently may be, provide by law for the establishment of schools throughout the state, in such manner that the poor may be taught gratis.”

The Ronald McDonald House in Hershey opened its doors in 1984 to provide lodging accommodations and compassionate support for families who have children with a life-threatening illness. Twenty-four years later, this home-away-from-home continues to serve families of pediatric patients who are being treated at the Penn State Milton S. Hershey Medical Center. But without the support from donors, volunteers, local McDonalds’ restaurant owners and a Board of Directors, none of this would be possible.

For the past two years, the General Assembly has been talking the talk of reform, but they haven’t been willing to walk the walk. Despite the best efforts of a few to move much needed institutional reforms, constitutional amendments, and other proposals have gone nowhere this legislative session. I have come to the conclusion that the only way we will have systemic reform of the Commonwealth’s government – i.e., to improve our legislative, executive and judicial processes – is to convene a constitutional convention that empowers the citizens of this state to become invested in their government again and provide its people the best opportunity to be heard.

He was convicted in 1975 for sexually molesting three girls from his church school. During his time in prison, he escaped twice. Although his plans following this release are still unknown, Feigley's possible return to our area has led me to take action.

As reform legislation continues to languish in the General Assembly, it has become clear to me that convening a constitutional convention is our best and only hope to create a new system of governance in Pennsylvania. So many of our problems – for example, the pay raise vote, the recent Bonusgate allegations, and the gaming for property tax ‘relief’ debacle – are symptoms of a larger systemic problem that must be treated at the root if they are to be permanently fixed. That root is the state constitution.

Weekly Column: Loophole Needs Closed in Pennsylvania's Wiretap Law to Better Protect State's Citizens
It’s time Pennsylvania changes a state law that allowed lawyers to obtain the phone records of police and prosecutors without notifying them. The lawyers used a subpoena to obtain 18 months of cell phone records from Sprint Nextel, the cell phone provider. Specifically, the records include those of Dauphin County District Attorney Ed Marsico and his First Assistant Fran Chardo, who oversaw the Grand Jury probe of allegations that Reverend Joseph Sica and Mount Airy Casino Resort owner Louis DeNaples lied about accusations with reputed mobsters, as well as the two state troopers who investigated organized crime for the Pennsylvania State Police.

A $28.26 billion state budget for fiscal year 2008-09 was recently adopted and signed into law. Senate Republicans were again successful at holding the line on taxes and reducing the Governor's proposed spending plan. For the first time during Governor Rendell’s six years in office, spending was kept below the rate of inflation. With an uncertain financial climate facing us all, this needed to be a year of caution and fiscal restraint. As many other states increased taxes and eliminated certain services, Pennsylvania was able to avoid such measures.

This month’s program will include Part-One of Pennsylvania’s Rare Books Tour. Piccola visits the State Library to view some of the Commonwealth’s oldest and rarest books and newspapers that have been preserved and restored after more than 250 years. Clare Zales, Deputy Secretary of the Department of Education/Commissioner of Libraries and Kurt Bodling, Rare Books Librarian, give Piccola a sneak peak of the collection including the 422-volume General Assembly Collection. Part-Two of Piccola’s library series will air in September and feature the new state-of-the-art facility within the State Library which will house these national treasures for generations to come.

In spite of this, the nearly 25-acre complex continues to be underutilized and is unable to operate in an efficient and effective manner based on its management framework.

Recently, a nationwide consumer alert was issued cautioning all citizens of an E. coli outbreak in spinach. E. coli – a product that lives in the intestines of cattle and other animals and typically is spread through contamination by fecal materials – has been detected on the leafy green. Supermarkets across the country have pulled spinach from shelves, and experts continue to probe the source of the contamination and warn consumers to refrain from eating any fresh spinach products.

Last week, we were reminded of this selfless dedication and service when a local firefighter made a dramatic rescue to save a young boy in Harrisburg. After climbing a number of stairs and fighting smoke-filled hallways and flames from a second-story home, the five-year veteran of the Harrisburg Bureau of Fire carried the two year old child to safety.

Help is available to those with low household incomes to meet the costs of heating their homes during the cold winter months. The Pennsylvania Low Income Home Energy Assistance Program (LIHEAP) is available to help low income people pay their heating bills through energy assistance grants. Eligible low income households may receive cash benefits to help pay for their home heating fuel and, if needed, a crisis benefit to resolve weather-related, supply shortage, and other household heating emergencies.

The EITC program, recognized as a national model for education tax credits, has funded more than 20,000 scholarships this year alone and more than 35,000 since its inception. To date, the business community has contributed more than $100 million to further the education of children in our public and non-public schools.

Pennsylvania has options to help mothers in crisis through the Commonwealth’s “Safe Haven” program, which protects newborns and helps parents of unwanted newborns find safe alternatives to abandoning babies. This program is administered by the Pennsylvania Department of Public Welfare and requires all hospitals in the state to be a “safe place” for a parent in crisis to bring an infant up to 28 days old without fear of legal repercussions.

Statement: Senate Education Hearing on Accountability Conducted
During a recent committee hearing, my colleague Senator Jim Rhoades, Chairman of the Senate Education Committee, and I were pleased to hear testimony on an important new development in education. This development involves the analysis of student tests, such as the PSSA and Terra Nova, to enhance a teacher’s ability to provide more effective instruction for their students. Testimony was heard at the hearing by two superintendents who have made use of this “value added” method of tracking student performance and enhancing instruction in their districts. The superintendents included: Dr. Stephen Iovino of the Warwick School District and Mrs. Sharon Kirk of the Dubois Area School District.

Statement: Legislation to Permit Capping of Medical Liability Lawsuit Awards
On March 9th, the full Senate considered and voted on Senate Bill 9, which would help to restore fairness, common sense, and personal responsibility to Pennsylvania’s legal system. SB 9 has now been referred to the House of Representatives for consideration. If approved by both the House and Senate in two consecutive legislative sessions, this change would allow Pennsylvanians to decide if limitations, or caps, should be placed on non-economic damages, or “pain and suffering” in medical malpractice cases. Economic damages, which compensate people for medical expenses and lost wages, would not be affected by the proposal.

The Pennsylvania Low Income Home Energy Assistance Program (LIHEAP) is available to help low income people pay their heating bills through energy assistance grants. Last week, Governor Rendell broke another promise to Pennsylvania physicians, hospitals and other health care providers by failing to provide a solution in terms of medical malpractice relief. Weekly Column: Senate Passes Education Funding Bill
Last week, the Senate passed House Bill 564, legislation that would end the current budget stalemate in an effort to ensure that schools do not experience a gap in state payments. House Bill 564 passed the Senate by a vote of 28-19. Because Governor Rendell vetoed a $4 billion appropriation for basic education funding in March, I strongly urged the passage of House Bill 564. This new measure would provide that schools are able to continue operating without a gap in state payments because the first basic education subsidy payment is scheduled for August 30. This legislation now returns to the House of Representatives for action.
